Warner Brother can retain the rights to Superman if they put Superman in public domain before 2013.

WB brothers giving out a note “I grant Superman to the public domain.” to the U.S. Copyright Office

The Superman trademark will belong to everybody while Superman will be copyright free.

This a loophole that would allow WB Brothers to keep the superman rights without paying any money for the image of Superman and they will not have to pay money to use the Superman trademark because WB brothers are only ones that will own Superman Trademark.

Everybody will own Superman once it goes into public domain.

what about the Death of Superman, because the superman sh#$ gets old, this dude could destroy anyone yet they make him out to be a wimpy loser in every movie. People really dont want to see Clark Kent they want SUPERMAN, THE MAN OF STEEL!!!!

Warner Bros losing Superman would be terrible. Without Superman we wont get a Justice League movie. All Warner Bros needs is a director that can take this project on and totally rock it

I have a feeling that DC is going to appeal this decision, citing the amount of time needed to develop and release a movie of the magnitude of Superman films. I wouldn't be surprised if they won the appeal and got an extra year to get things done. I have to agree with Keith, we don't need FOX anywhere NEAR Superman. The big problem in all this is money, and I think if DC gets some big cash kickback from WB the problem might be solved until 2013.

The real question is when Warners is going to make a movie about Reject Man. The realer question is why we haven't gotten sued for copyright infringement.

My prediction: no more Superman movies.

It just doesn't make sense from WB's standpoint. Nowadays the box office performance of big event movies tends to be tied to audience perception of the predecessor. It's why Batman Begins made barely $200 million and The Dark Knight made over $500 million — both were extremely well received films, but the former had the albatross of Batman & Robin hanging over its shoulders, while the latter was able to capitalize on the good will the predecessor had finally brought to the film franchise. If a Superman movie in 2013 was exceptionally well made, it would probably have more of an impact on the box-office success of the sequel, which WB would no longer own. They could do a lower budget ($100 million or so) sequel with the same cast as the 2006 movie (sans Spacey) and hope for the best, but in that case the movie probably wouldn't make much more than $100 million under a best case scenario, so what would be the point?

This is good news. We will get one last WB Superman movie (probably with Brandon Routh for time saving reasons) that features other members of the Justice League (and I'm hoping would have Batman in it although that would probably mean that WB is shooting itself in the foot and it would be some hammy actor instead of Bale) and completely different version of Superman in the future (if WB dont get the rights back).

Now I'm hoping that WB don't get the rights back because they just haven't milked his super-titties right over the years (another reason the Siegel heirs might not sell it back to them).

They “Won” in the sense that they didn't have a “Sweetheart” deal with DC, which is what Siegel's camp was suing about. If it could be proven that WB made special arrangements with DC, then it would mean that they could be “hiding” money from the Siegel/Schuster's. The judge said that what Warner pays DC for rights is pretty good, based on what, say, Fox pays to Marvel for X-Men. That's pretty much the jist.

That wouldnt work. Nolan's Batman has worked so well because its based in the real world. If you throw in a guy who can fly everything they worked for in the past 2 movies gets tossed out the window.
